Holding / Regulatory
Restoration of forfeited licences
Governmental and state institutions tend to take a formalistic approach towards taking adverse decisions affecting businesses and companies. However a licence as property is protected by fundamental human rights directly applicable in every country in Europe and other states where relevant human rights are applied. Expropriation of licences must comply with rigorous criteria that balance public benefit and limits to licence-holders’ rights. Therefore even if the substance of a client’s actions was correct, forfeiture of a licence requires immediate attention and subsequent reaction to ensure a proper legal solution. Our experience shows that correct handling of the situation enable companies to survive while the licenses they need are recovered.
